Nursing home residents and workers have accounted for roughly 162,000 deaths, or 1 in 3 U.S. COVID-19 deaths. Horror stories both around the country and at home resound - workers and facilities did not follow protocol by allowing workers showing symptoms to continue working with the most vulnerable. And increasingly, the family members of those people who have died due to negligence are being left in the dust by harmful immunity legislation.
Legislative Alert! MO SB 51 is likely to advance the Missouri Senate to the House. This bill would drastically hinder access to courts, and settlements, for individuals who have contracted COVID-19 from a negligent business. The measure clearly looks out solely for big business interests while leaving real people with limited or no options to sue. Legislative Alert KS SB 151 Contingency fees allow for an individual to retain a lawyer without having to pay up-front. This fee system provides the poor, working, and middle classes the same access to our justice systems as big business and the wealthy. It is also how our firm operates - we believe that people who are dealing with injury, wrongful death and the like should not also have to worry about how they'll afford an attorney. Kansas' SB 151, introduced last week, seeks to cap contingency fees for plaintiffs' attorneys, while putting no limits on the amounts that large, out-of-state corporations can pay their attorneys. "The Missouri legislature is currently discussing liability protection bills. The main measure would protect business owners from lawsuits unless clear and convincing evidence shows recklessness or willful misconduct. If a business owner posts a sign, the bill says, the customer or client assumes all risk for COVID-19 exposure that may occur on the premises. It sets a one-year time limit for claims." Prior to joining Smith Mohlman, Oscar worked as a claims adjuster for several large insurance companies and also as a defense attorney, representing the insurance companies' clients in hundreds of cases involving motor vehicle accidents, slip and falls, ...and wrongful death matters. Oscar is excited to use the skills that he has learned as an insurance defense attorney to vigorously advocate for Smith Mohlman's clients. Oscar was born in Managua, Nicaragua, and is fully fluent in Spanish. Oscar attended high school in Humble, TX and then continued his education at Baylor University in Waco, Texas, where he earned a Bachelor of Science degree in Forensic Science. After graduating from Baylor, Oscar attended the University of Kansas School of Law, where he earned his Juris Doctorate in 2007. In his spare time, Oscar enjoys spending time with family and friends, traveling, gaming, and cheering for the Baylor Bears.
The bill, to be introduced in the House next week by six Republican co-sponsors, "would give nursing homes protection from civil lawsuits if they are found to be compliant with safety protocols."
"The bill approved by Congress requires emergency rooms to bill patients at network rates, regardless of whether the patient is in the network. It protects patients from charges that occur when out-of-network doctors assist with procedures at in-network hospitals."
Nursing home directors say it's "just short of a miracle." Vaccinations for their residents and staff, rolling out this week, could reach 100,000 Missourians and 40,000 Kansans.
Behavior rewarded is behavior repeated. "If passed, a liability shield provision championed by a senior member of the Senate GOP would prevent workers and consumers from bringing lawsuits against employers who don’t take proper safety steps to limit exposure to the virus."
Area nursing homes hope that the vaccination for both staff and residents will finally allow the opportunity for long-awaited visits with loved ones.
Larger, corporate facilities are stockpiling PPEs, leaving smaller and rural clinics and their residents at a loss.
