That’s a prosecutor’s call, he said. It is not for them to determine whether or not a crime has been committed. It’s a cop out, Picerno added. It is a way for them to not have to file cases against their brothers and that’s all that is.

He received sentences of 10, 3, and 3 years respectively, to be served concurrently! We believe our client acted in lawful self defense, however, the prosecutor agreed not to file an additional charge of Felon in Possession of a Firearm. This charge likely would have resulted in the same length of sentence or more! See more

Last afternoon in the office this year! An appreciative client brought by an early Christmas gift! Merry Christmas Eve Everyone!
Notable Result: Judge sustained a major 5 point objection, (escaping a 324-405 month guideline sentence), which meant the Defendant was facing a sentence of 188-235 months. He received a 112 month sentence, which was 18 months more than the recommendation from the Government. All in all, a pretty good result!
According to the Lawrence Journal-World, McGowen faced a disciplinary hearing in early October for her conduct and will face another at a future date. While the hearing is what Smith calls a step in the right direction, she says every case McGowen has been involved in needs to be reviewed.
